These Terms and Conditions govern your use of the services and products provided by MyProtector. By purchasing or subscribing to our services, you agree to be bound by these terms.
1. PARTIES & DEFINITIONS
1.1 Company: MyProtector Ltd (trading as MyProtector), Company No. 15386941.
1.2 Registered Office: Cobalt Square, 83–85 Hagley Road, Birmingham, B16 8QG.
1.3 Customer: The individual purchasing the System as a consumer.
1.4 System: The MyProtector wireless emergency panic button and 24/7 monitoring services provided by the Company.
2. KEY TERMS
2.1 Minimum Term: 24 months for monthly plans. Early termination by the Customer requires payment of all outstanding monthly fees for the remainder of the Minimum Term.
2.2 Cooling-Off Period: You have the right to cancel within 14 days of delivery. A full refund will be issued minus a £55 administrative fee.
2.3 Service Limitations: The Company does not guarantee uninterrupted service. Outages may occur due to third-party network failures, maintenance, or unforeseen issues.
3. SYSTEM & SERVICE
3.1 Functionality:
3.1.1 The System sends alerts to designated contacts and/or emergency services via landline, broadband, or cellular networks.
3.1.2 The System includes 24/7 monitoring, but response times may vary due to external factors beyond the Company’s control.
3.2 No Guarantee:
3.2.1 The System is not a substitute for professional medical, police, or fire services.
3.2.2 The Company cannot guarantee a particular outcome or emergency service response.
4. LIABILITY
4.1 Exclusions:
4.1.1 The Company shall not be liable for failures caused by third-party service providers (e.g., broadband, mobile networks).
4.1.2 The Company shall not be liable for misuse, tampering, or incorrect installation of the System by the Customer or others.
4.2 Non-Excludable Liabilities:
4.2.1 Nothing in this agreement excludes or limits the Company’s liability for death or personal injury caused by its negligence.
4.2.2 Nothing in this agreement excludes or limits liability for fraud or fraudulent misrepresentation.
4.2.3 The Company’s total liability for all other losses or damages arising out of or in connection with this agreement shall be limited to the amount paid by the Customer for the System.
5. DATA PROTECTION & PRIVACY
5.1 Data Collected:
5.1.1 Personal details (name, address, contact information).
5.1.2 Emergency contact information.
5.1.3 System usage data such as alert times.
5.2 Use of Data:
5.2.1 To provide and maintain the System and monitoring services.
5.2.2 To communicate with emergency contacts or services during an alert.
5.3 Data Sharing:
5.3.1 Shared only with emergency services, designated contacts, monitoring centres, telecom operators, and affiliated companies as necessary for service provision.
5.4 Data Retention:
5.4.1 Personal data retained for 24 months after contract termination.
5.4.2 Emergency contact details deleted upon request.
5.5 Your Rights:
5.5.1 You may request access, correction, or deletion of your personal data.
5.5.2 Complaints may be submitted to the Information Commissioner’s Office (ICO) at www.ico.org.uk.
6. PAYMENT & TERMINATION
6.1 Fixed Pricing: Prices are fixed for the 24-month term.
6.2 Early Termination: The full remaining balance of the Minimum Term is payable upon early cancellation.
7. GENERAL
7.1 Governing Law: This agreement is governed by English law. Any disputes shall be resolved exclusively by the courts of England and Wales.
7.2 Amendments: Any changes to this agreement must be in writing and agreed by both parties.
YOUR STATUTORY RIGHT TO CANCEL (COOLING-OFF PERIOD)
If you are a consumer, you have the right to cancel this agreement within 14 days of receiving your equipment, without giving any reason.
